Please read this carefully, I have the right to refuse a commission based on these terms.

If you cannot comply with these terms of service, you may not request services from me in any form.

My art is not to be used as a base, traced, heavily referenced, NFT, or any form of AI site. Any such usage is an automatic blacklist and may result in a PSA.

You agree to only use the commissioned/requested/traded art for personal, non-profit gains unless a commercial usage fee has been paid.

You agree to give me, the artist, substantial time to finish the art given the knowledge that I am disabled and work two jobs. Reasonable turnaround time is 1-4 months for me unless otherwise stated, but then I will communicate.

You agree to link back credit to me in all circumstances when reposting. Violators will be blacklisted without warning.

You will have read these terms and agree to comply with them, it will be assumed by me that by commissioning, trading, or requesting art from me you have read these TOS and agree to them.

You may not claim any of my works as your own in any form.

You understand that my art style is still in its early stages and is still evolving. I am still new to digital art. While I am developing my style, my art may not all look the same. Please take that into consideration when trading with or commissioning me.

As the artist, I reserve the right to post WIPs, stream progress, or post the process video of a commission/art trade/request unless specifically agreed upon otherwise.

I reserve the right to post the finished product in my gallery as part of my portfolio.

I can decline commissions for any reason. I reserve the right to keep my reasons private if I so choose. I will usually disclose why I decline a commission, unless I am uncomfortable doing so.

I do not draw: mecha, children/characters visibly underage, elderly, realistic furry, animals, extremely complex designs, hate art, or anything else offensive or that makes me uncomfortable.

I can refund you the full amount and cancel the commission at any time if I deem it necessary. Life is unpredictable. Please be aware of this.

DO NOT feed my art into ANY AI programs. If I find out you have done so, you will be blacklisted and I will put out a PSA on you.

You may request to have a completely private commission or art trade, however it must be stated during the ordering process.

My fiance lives with me and will see my art. Be aware of this if you have a really private commission that you only want the artist and yourself to see. This is unavoidable.

I can make sure not to post WIPs online or stream the process online. At the time of writing this TOS, I do not currently post many WIPs or stream anyway, but that may eventually change.

By choosing this option, you also agree to not share any WIPs online via any social media.

This service is currently free. This is subject to change at any given time without warning.

The following are considered commercial usage: Vtubers, Patreon banners, YouTube, Twitch, a personal site, business cards, novels, etc.

If commercial use is requested, the usage fee is a flat $100 USD for commercial usage, no matter what type of commission you are getting from me unless otherwise stated.

I reserve the right to have my watermark on my art pieces, commissioned or otherwise. Full resolution images will be sent upon completion, but will remain watermarked. Intentional removal, cropping, or editing of the watermark is a violation of the TOS.

I will not take credit for the designs of other creator's designs. I will always credit the original designers when drawing an OC or adoptable.

Please give visual references only, and have a clear reference sheet for each character. Written side descriptions are welcomed, but I cannot only go off of written descriptions.

I can use moodboards for customs and adoptables.

In the case of art trades, I will send you a heavily watermarked version of my part upon completion. This is so I don't just give art away. The clean version will be sent once your part is complete.

For commissions, I currently accept PayPal through VGen or Ko-fi.

Charge backs will not be tolerated and will result in an immediate blacklist and possible PSA.

After 100% of the payment has been sent, I will add you to my trello docket.

I accept all currency. Currency can be converted using PayPal.

Repeatedly backing out of commissions will result in blacklisting!

Once the sketch has been started, there are NO REFUNDS

If the sketch has not been started, I can refund 100% of the payment.

Even if the sketch has been started, if I am responsible for the cancelation I will refund you 100%.

Repeatedly requesting refunds will result in blacklisting.

In the case of adopts and customs, you are responsible for protecting your ownership of a character design made by me by creating a copy of the image with your watermark on it as well when uploading on external sites.

For customs and adoptables, I will not reuse or resell the rights to the design once ownership is transferred to you. In the event a design is accidentally sold twice, a refund will be issued to the second buyer and the matter will be addressed to both buyers.

If a design is a closed species and the buyer wants to remove it from the species, they must provide a new reference image and be marked off properly as an ex-species.

If a design is gifted, it loses its monetary value until it has NEW art commissioned by the new owner. Those found reselling gifted designs will be blacklisted.

I will not copy a pre-existing design. No canon character based designs/kinsonas. I understand there is no such thing as a perfectly original idea in today's age as certain aesthetics develop- however directly copying someone else's designs will not be tolerated and I will not partake in such activities.

In the event you do not have a reference for your character, the custom character price will be added on to your commission. This includes AI generated images and written descriptions!! I DO NOT work with written references!!
